Welcome to Comfort Health Aid. These Terms and Conditions ("Terms") govern your access to and use of our website, services, and newsletter. By using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. About Our Services

Comfort Health Aid provides home-based health and wellness management services, including but not limited to general healthcare, senior care, cardiology support, nutrition counseling, weight management, and wellness programs. All services are delivered by licensed professionals operating under applicable state and federal regulations.

2. Eligibility

To use our services, you must:

• Be at least 18 years of age, or have a legal guardian consent on your behalf.
• Be physically located in the United States (or have coverage in your state).
• Provide accurate, current, and complete information during registration.
• Have the legal capacity to enter into binding agreements.

3. Booking and Appointments

3.1 Booking Process

Appointments are subject to availability and confirmation by our care coordination team. Submitting a booking request does not guarantee a confirmed appointment.

3.2 Cancellations and Rescheduling

• Cancellations must be made at least 24 hours before the scheduled appointment.
• Late cancellations or no-shows may incur a fee of up to 50% of the scheduled service cost.
• We reserve the right to cancel or reschedule appointments due to clinician unavailability, weather, or emergencies.

4. Membership Plans and Payments

4.1 Plans

We offer Essential Care, Premium Wellness, and Elite Concierge membership plans. Prices are as advertised and subject to change with 30 days' written notice.

4.2 Billing

• All fees are billed monthly on the date of your first enrollment.
• We accept major credit/debit cards, HSA/FSA cards, and ACH transfers.
• Late payments may incur a $25 late fee and service suspension.

4.3 Refunds

• New members may request a full refund within 7 days of first billing if no services have been used.
• Partial refunds are available for unused services in annual plans.
• Refunds are processed within 5–10 business days.

You agree to:

• Provide truthful and complete medical history and information.
• Follow the care plan provided by your clinician to the best of your ability.
• Notify us immediately of any changes in your health, medications, or contact information.
• Maintain a safe, accessible environment for home visits.
• Treat our staff with respect and professionalism.

7. Intellectual Property

All content on our website — including text, images, logos, graphics, and software — is owned by Comfort Health Aid or its licensors and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or use our content without express written permission.

8. User Conduct

You agree not to:

• Use our services for unlawful purposes.
• Transmit malware, spam, or harmful content.
• Attempt to gain unauthorized access to our systems.
• Harass, threaten, or impersonate any person.
• Reverse-engineer or scrape our website or apps.

9. Newsletter and Marketing

By subscribing to our newsletter, you consent to receive marketing emails from Comfort Health Aid. You can unsubscribe anytime via the link in each email or via unsubscribe.html. We will never sell or rent your email address.

10. Limitation of Liability

To the maximum extent permitted by law, Comfort Health Aid and its affiliates, officers, and clinicians shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services or website, even if advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold Comfort Health Aid harmless from any claims, damages, or expenses (including legal fees) arising from your use of our services, violation of these Terms, or infringement of third-party rights.

12. Termination

Either party may terminate services at any time:

• You may cancel your membership with 14 days' written notice.
• We may suspend or terminate services immediately for non-payment, policy violations, or unsafe behavior.
• Medical records will be retained per state law regardless of termination.

13. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be settled by binding arbitration in Clovis, New Mexico, under the rules of the American Arbitration Association.

14. Governing Law

These Terms are governed by the laws of the State of New Mexico and applicable federal laws of the United States, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Comfort Health Aid and supersede all prior agreements or understandings.

17. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes constitutes your acceptance of the revised Terms.
